ROSS WINES: TERMS AND CONDITIONS

STANDARD DELIVERY

Our standard delivery target is up to three working days and at a cost of £10 per delivered address, regardless of the number of cases (6’s and 12’s) which make up the one delivery drop.

If the value of the delivery is over £75 then we offer free delivery within mainland UK.

Delivery to the Scottish Highlands, some of the other remoter areas of Scotland, Northern Ireland and the islands (see below) can take an extra three days over our standard delivery of up to three days and the shipment cost is more.

Deliveries within mainland UK are undertaken end-to-end (“door to door”) by APC Overnight Limited (“APC”). APC manages deliveries to the islands (Channel Islands; the Isle Man and the Isle of Wight) also Ireland and overseas (as an export).

APC works internationally with Air Menzies International. APC are specialists in the safe and secure carriage of glass and of alcohol. APC will require the delivery to be signed for by an adult if a “signed for delivery” condition is your request.

If the cases are left in a secure location out of sight to the public then the cases and contents are your responsibility from the moment when they are deposited in your premises / home or left with a neighbour. APC reserve the right not to accept the signature of any person considered to be under the age of 18 (and not presenting satisfactory proof of age) or if the cases are expected to be left in an insecure location.

RETURNING YOUR WINE AND RECEIVING A REFUND

We will need your original delivery date / unique reference number and the delivery address; the chosen address (where the cases have been left out of sight) for the collection plus a mobile phone attended during the collection date.

The collection should take place within three working days of the booking date.

We accept full responsibility for your wine from the moment it is loaded onto our carrier’s vehicle.

If the collection fails to take place, then please contact this office and we will be pleased to rearrange for a more suitable day.

Once the wine is back with us, we will check the returns and refund the cost of cases and part cases, at the same price as you paid in the first instance to the credit card used to make the original purchase.

GUARANTEE OF SATISFACTION

We confidently guarantee the quality and value for money every bottle which we sell.

If a wine fails to satisfy you, for whatever reason, then we will arrange to collect it and refund you with the original cost or replace the wine with a different wine to an equivalent price, at your preference.

TERMS AND CONDITIONS OF SALE AND USE

These Terms apply if you want to purchase products from us or use our website, brochures, advertisements or app (“the Site”).

These Terms must be read together with our Privacy and Cookie policies.

Please review these Terms carefully before using the Site or purchasing products from us.

We change the content of the Site from time to time, including putting new wines on offer for sale, withdrawing wines when out of stock and changes in the terms of use.

By using the Site you agree that you have understood and accepted these Terms: this is a pre-condition of you using the Site.

References to “we” and “us” refer to Ross Wines whose business office is at The Old Court House, 53 High Street, Ross-on-Wye HR9 5HH

TERMS OF BUSINESS

The placing of an order does not constitute a contract of sale. The acceptance of your order and the sales contract between you (the “customer”) and Ross Wines will occur when the goods which you have ordered are despatched to you and payment has been received for the full invoiced amount.

From time to time we do not or cannot accept an order(inter alia) because:

  • the product(s) selected is / are unavailable from current stock;
  • we have been unable to obtain authorisation for your payment
  • your inability to verify that you are aged 18 or over.
  • the identification of a pricing or product description error
  • the repeated or fraudulent use of vouchers.

SUBSTITUTION

If part of your order is unavailable at the time when the order is to be shipped, then we will ship those wines which are available and we will reduce the charge to your credit card to reflect the reduced purchase consideration.

PRICES

All prices are quoted in pounds sterling, and may be per bottle or per case, as indicated.

The prices include UK duty and VAT.

Any delivery charges are additional, unless otherwise specified.

We endeavour to ensure that all price information on our Site is accurate and up to date at all times.

If a product which you have ordered is listed at an incorrect price then we will contact you by telephone or email before despatching your products asking you to confirm if you still wish to proceed with your order at the correct price or cancel your order.

We reserve the right to alter our prices without advanced notice if caused by major currency fluctuations, changes in the rate of duty, VAT or other taxes, market conditions. We also reserve the right to terminate any special offer at any time, without advanced notice.

AVAILABILITY OF PRODUCT

All products and services are subject to availability but wines runs out from time to time.

Many wines are categorised by year: we will sell and ship these wines on an “oldest-first” basis.

If one year’s stock expires then we will ship the same wine for a later year.

We will not ship a substitute wine without your prior approval.

DELIVERY

We deliver throughout the UK.

Various delivery times may be available for you to select at the time when you place an order.

Details of any timing options available will be specified at the time of placing your order.

We reserve the right to restrict deliveries or to withdraw our delivery service in toto to those individual customers’ addresses if they are repeatedly unavailable to take delivery or in other exceptional circumstances.

Our deliveries are made by a professional third-party carrier: APC Overnight.

Some standard deliveries may not require your signature or that of another party signing on your behalf with your approval.

If you are not at home, then the delivery driver may be able to leave your order for you in accordance with the “leave” instructions which you gave us when you placed your order in a safe place and out of public view or at a neighbouring address, and if this is not possible, a card will be posted through your letterbox with instructions as to how to arrange a re-delivery.

Please keep your delivery note and all packaging and notify us immediately if any of the order is missing or damaged.

Should you request the wine to be delivered on a “signature required” service, please ensure that you (or your nominee) are available to sign for the delivery.

Free delivery applies within the UK when your purchase exceeds £75 (including any applicable VAT) in a single order and is for our standard delivery service to a single UK address only.

CANCELLATIONS, REPLACEMENTS AND REFUNDS

If you buy any of our wines and it is damaged or not up to your standard or you just do not like a bottle, please refer to our returns policy.

If you change your mind about some or all of your order, then you can cancel your order up to 14 calendar days after the day on which you received your order.

You may return part or all of the order and we will arrange to collect the unwanted wines and reimburse the appropriate cost paid including the actual original delivery cost within 14 calendar days after the day on which you tell us that you wish to cancel.

The return is free of charge.

However, if you open a bottle of wine or break / remove a seal, whether or not you pour any part of the contents out of the bottle, then we will reduce your refund to reflect the reduction in the value of the returns.

Please let us know if you wish to cancel an order by contacting our Customer Services team by phone or email. If by e-mail or in posted writing, please include details of your order (unique reference number) to help us identify it.

All refunds given will be made by the same payment method (same credit card and account) which you used to make the original payment.

GUARANTEE OF QUALITY AND VALUE FOR MONEY

We are confident that our wines represent quality products and good value for money.

However, assessing either dimension is essentially a subjective decision. “Chacun a son gout.” We are pleased to replace or refund any bottles of wines which are faulty or which you do not enjoy, subject to the certain conditions:

IF THE WINE IS FAULTY

If a bottle of wine is corked or otherwise defective and out of condition (provided it is before the recommended “drink-by” date and has been stored in suitable conditions), then we will replace the faulty bottle with a bottle of the same type of wine or if not available, a bottle of another type of wine of equivalent price.

Alternatively, we will refund you with the cost of the bottle.

IF YOU DO NOT LIKE THE WINE

If, having opened a bottle, the wine is not to your taste, (and provided it is before the recommended “drink-by” date and has been stored in suitable conditions) we will replace the bottle with a bottle of equivalent value.

Alternatively, if you prefer, we will refund the value of the bottle. Any more unopened bottles of the same wine can be collected from you (free of charge) and replaced with bottles of equivalent value or a refund.

LEGAL RIGHTS OF THE CUSTOMER

This Guarantee is in addition to, and does not affect, your legal rights in respect of any of our products.

We are under a legal duty to supply goods in conformity with this contract.

You have certain legal remedies if we breach these rights. For more information about your legal rights, please contact your local Citizens Advice Service or Trading Standards.

AGE RESTRICTIONS UK LICENSING LAW

The Licensing Act 2003 does not permit the sale of alcohol to any person under the age of 18: they may not buy, or attempt to buy, alcohol for themselves.

No-one may buy alcohol for any person under the age of 18.

At Ross Wines we support and adhere to these legal and social obligations as a retailer of alcohol.

By placing an order, you confirm that both you and the recipient of the wine are at least 18 years old.

If our couriers are in doubt of the age of the prospective recipient of an order, then they will require some form of ID.

In the event that this is not forthcoming, then they are under an instruction not to leave the wine.

ROSS WINES

Ross Wines reserves the right to verify names, addresses, age and other personal information supplied by you during the purchase process.

By accepting these Terms and Conditions you authorise Ross Wines to make such checks at its sole legal discretion. Personal information provided by you may be disclosed to a credit reference or fraud prevention agency which may keep a record of that information.

This is done only to confirm your identity.

A credit card credit check is not performed as the legal minimum age to have such a card is age 18.

Ross Wines reserves the right to require other proof of age: if we cannot verify your age using your credit card then we will ask for a passport number or a driving licence number.

FRAUD AND CRIME PREVENTION

For the purposes of the prevention of fraud, the detection of crime, and the apprehension or prosecution of offenders, we may (be required to) supply any information that we collect to the police and other agencies in accordance with the relevant legislation.

LIABILITY

You have certain legal rights in respect of any products or services which you purchase in the UK: that such products are of satisfactory quality and are provided with reasonable care and skill.

You have certain legal remedies if we breach these rights.

Nothing in these Terms of Sale affects or limits these legal rights or other rights to which you may also be entitled, for example to damages.

For more information about your legal rights please contact your local Citizens Advice Service or Trading Standards Service.

Our liability to indemnify you for any losses, which you suffer as a result of us failing to comply with these Terms of Sale is strictly limited to any losses, damage or costs which are a foreseeable consequence of such a failure.

We are not responsible for any delay in, or failure of, performance of our obligations under these Terms of Sale arising from any event which is outside of our control (for example, an act of God, governmental act, war, fire, adverse weather conditions, failure of a third party) In the event of a significant delay or failure, we will contact you and take reasonable steps to minimise the impact thereof.

If you are unhappy with a delay which affects your order, you may cancel the order and receive a refund for any products you have paid for but not received by contacting us.

We will not be liable to you or to any third party for any loss, damage or costs which arises as a result of your failure to handle any product in a safe manner

RISKS, WARNINGS AND STORAGE CONDITIONS

You should be aware of the following inherent risks and warnings in respect of our products: alcohol should be consumed sensibly and in moderation.

A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight, then we advise that you transfer the bottles a few at a time.

Red wine, in particular, may cause staining if spilt so extra care should be taken.

Sparkling wines and champagnes can be volatile due to the build-up of gasses.

Extra care should be taken when opening these.

The correct storage of wine is of vital importance. Where possible, you should store bottles with corks horizontally, at a stable, cool temperature, out of direct light and, in an environment, which has some moisture in order to avoid the drying out of corks.

The wine should be subject to as little movement as possible.

Selection, basket and purchase areas of the site require you to register an account with us to purchase products.

INTELLECTUAL PROPERTY RIGHTS

All present and future copyright, design rights, unregistered designs, database rights, registered and unregistered trade marks (including the Ross Wines trade mark) and any other present and future intellectual property rights and rights in the nature of intellectual property rights existing in and to the site including content published on them such as text, graphics, logos, banners, images, buttons, underlying source code and software, are owned by Ross Wines.

Nothing in these Terms shall be construed as an assignment to you of any such intellectual property rights.

PRIVACY AND DATA PROTECTION

We process information about you in accordance with our Privacy Policy. By using the site you consent to such processing and you warrant that all data provided by you is accurate.

We expressly exclude, all liability for Ross Wines, its directors, employees and other representatives, however arising, for any loss or damage suffered as a result of your use of, or inability to use, the site; or reliance on any content displayed on the site.

Information transmitted via the site will pass over various public telecommunication networks.

We make no representation or warranty that the operation of the site will not be uninterrupted or error free and we will not be liable to you.

The site may include links to website and/or services owned and/or operated by third parties.

These are provided for your convenience only.

We are not responsible for and do not give any warranties or make any representations regarding any such website and/or services, their content or your use of them.

This section does not apply to our obligations under the Terms of Sale or affect your legal rights as a consumer in respect of any of our products or services (for example, if any of our products do not match the description given to them on the Site).

TERMINATION

We reserve the right to suspend your use of the Site at any time for operational, regulatory, legal or other reasons.

We may update or amend these Terms from time to time to comply with law or to meet our changing business requirements by amending this page without notice to you.

Such changes will be effective as soon as they are posted on the Site. By continuing to use the Site or purchasing products or services from us, you agree to be bound by the terms of these updates and amendments.

OTHER IMPORTANT TERMS

These Terms are governed by the laws of England and Wales and the Courts shall have jurisdiction over any disputes arising under or in relation to them and any contract made under them.

If any of these Terms are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, then the rest of the Terms remain in full force and effect.

We may freely transfer or assign any portion of our rights or delegate our obligations under these Terms.

You are not entitled to transfer or assign, by operation of law or otherwise, any portion of your rights or delegate your obligations under these Terms without our prior written consent.

These Terms, the Privacy Policy and the Cookie Policy set out the entire agreement between you and us and replace any and all prior terms, conditions, warranties and/or representations to the fullest extent permitted by law.

Any delay or failure by us to exercise any right we may have under these Terms does not constitute a waiver by us of that right.
